On Friday, January 30, 2015, Member John Butler obtained a significant monetary recovery for his contractor client in proceedings before the Hon. Jack Nevin, Pierce County Superior Court. The client asserted a breach of contract action against a local high-speed internet service vendor, alleging non-payment of outstanding construction contract payments. Mr. Butler obtained a six-figure judgment against the vendor, then successfully confirmed the judgment when the vendor attempted to vacate it. In post-judgment recovery proceedings, Mr. Butler obtained a judgment on a writ of garnishment that the vendor had also contested. The client’s monetary recovery to date covers the original judgment amount, a large portion of the accrued post-judgment interest and allowed attorneys’ fees. Assisting Mr. Butler on the case was associate Amber Gundlach.
