Member John Butler and Associate Jennifer Loynd have co-authored an article appearing in the Summer edition of the Defense News, published by the Washington Defense Trial Lawyers Association.  The article is entitled Decoding Eastlake v. Hess: A Case Study in Applying an Alternative Measure of Damages, and discusses Mr. Butler’s and Ms. Loynd’s recent trial experience in defending a construction defect case.  By successfully applying a judicially-recognized “diminished value” alternate measure of damages for construction defect claims (rather than the much more expensive “cost of repair” measure of damages), Mr. Butler and Ms. Loynd managed to significantly reduce the damages claimed by Plaintiffs at trial.  For more information on their experience, please contact them by visiting our “Attorneys” page above.
