DRI members Eric P. Gillett and Rachel Tallon Reynolds from the Seattle office of Preg O’Donnell & Gillett, PLLC, obtained a defense verdict following a seven-day trial in Snohomish County Superior Court for its client, United Parcel Service, Inc. The personal injury claim arose out of a dramatic collision with two semi-trucks that occurred on Interstate 5 near Chehalis, Washington, in January 2009. The plaintiff, who was standing outside his truck when the collision occurred, alleged that he suffered permanent brain injury, memory loss and cognitive dysfunction, as well as a multitude of physical injuries. He had not worked since the date of the accident. The plaintiff asked the jury to award approximately $2.3 million. Even though there were no eyewitnesses to the plaintiff’s injury, the defendants introduced evidence that the plaintiff was actually not struck in the accident but slipped on a wet grassy slope next to his truck after the collision occurred.
