POG attorneys Chris Roslaniec and Amber Hazelquist prevailed on insurance bad faith claims and obtained a favorable jury verdict on Plaintiff’s UIM claim in the Eastern District of Washington after a four-day jury trial.
This matter arose from an admitted liability Underinsured Motorist claim as well as claims of bad faith, violation of the Insurance Fair Conduct Act, Violation of the Consumer Protection Act and negligent claim handling against Plaintiff’s UIM insurer. The jury returned a defense verdict on all of Plaintiff’s direct claims against their insurer. Plaintiff asked for $6 million in damages at trial, and the jury returned a verdict of only $750,000 on the admitted liability UIM claim, which was below an offer of judgment made by Defendants several months before trial.
