Preg O’Donnell & Gillett is pleased to announce the dismissal on summary judgment of the alleged employment discrimination and failure to accommodate claims filed against one of the firm’s clients.

The team of Justin Bolster and Naomi Ahsan utilized a tailored discovery plan to obtain key factual admissions that were critical in articulating to the judge why there were no questions of material fact in dispute and that the plaintiff failed to meet their burden to survive the motion to dismiss. The plaintiff attempted, at the last minute, to seek additional time to conduct discovery by requesting a hearing continuance, but thanks to the discovery plan used by our team, combined with the documentation submitted in support of the motion, the court found that the plaintiff failed to meet their burden of showing how any additional discovery could create a question of fact in light of the evidence submitted. Furthermore, as the judge explained at the hearing, the plaintiff failed to meet their burden of production and reiterated that the defendant’s actions were both reasonable and justified under the circumstances.

As a result, plaintiff’s claims were dismissed with prejudice. Our client was present for the hearing and thanked our entire team for the zealous advocacy and clearly articulated arguments to the court on their behalf.
